Welcome to OnRequest ("we," "our," or "us"). By accessing or using the OnRequest platform — including our website, mobile web app, artist dashboard, and any related services (collectively, the "Service") — you agree to be bound by these Terms of Service. Please read them carefully.

If you do not agree to these Terms, do not access or use the Service.

1. Who Can Use OnRequest

All Users

You must be at least 13 years old to use OnRequest. By accessing or using the Service, you represent and warrant that you meet this age requirement.

If you are between the ages of 13 and 18, you represent that you have the consent of a parent or legal guardian to use the Service and that they have reviewed and agreed to these Terms on your behalf.

Artists (account holders) must be at least 18 years old. By creating an artist account, you represent that you have the legal authority to enter into these Terms on your own behalf or on behalf of an entity you represent.

2. Accounts and Registration

Artists

To access artist features, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials, including any passkeys, passwords, or recovery codes. You are responsible for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep this information up to date. We reserve the right to suspend or terminate accounts that we believe contain false or misleading information.

3. The Service

All Users

OnRequest is a live music engagement platform that enables artists to interact with their audience during live performances and livestreams.

Through the Service, audience members may submit song requests, provide tips, purchase or use Tokens, and participate in artist-led sessions. Artists retain full control over performance decisions, including which songs are performed and in what order.

Audience interactions, including tips and Tokens, may influence how requests are presented within the Service but do not guarantee performance of any specific request.

The Service may include additional features such as merchandise purchasing, performance planning tools, and other interactive or transactional functionality.

Google Calendar and Google Drive

Artists

Artists may optionally connect a Google account to synchronize eligible shows and accepted gig offers with Google Calendar, browse Google Drive folders and import selected chord charts, or back up charts and export data to Google Drive. A synced event may contain the show or booking title, date and time, time zone, location, OnRequest links, and relevant booking details such as expected pay, shared revenue or profit, and rider information.

By connecting an account, you authorize OnRequest to make the Google API requests required for the features you use. These requests may create or update corresponding Calendar events, display Drive folder and file information, download a chart you select to import, create or use a destination folder, and upload files to Drive. Drive uploads currently include individual chart exports, ZIP bundles of selected charts, full-library backup files, and artist-requested audience-data exports; backup-queue files may also be uploaded to the folder you select. You confirm that you are authorized to connect the Google account and access, import, or export the content you select. Google's services remain subject to Google's terms and policies.

OAuth permissions requested: https://www.googleapis.com/auth/calendar.events, https://www.googleapis.com/auth/drive.file, https://www.googleapis.com/auth/drive.readonly, email, and profile.

You can disconnect the integration in OnRequest account settings or revoke access through your Google Account. Disconnecting stops OnRequest's future access but does not delete events or files already created in Google or content already imported into OnRequest; you must remove those copies separately. Google features depend on Google's services and authorization remaining available, which OnRequest does not control.

Our handling of Google API data is described in the Privacy Policy and is subject to the Google API Services User Data Policy, including its Limited Use requirements.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. Payments and Tips

4.1 Fan Payments

Patrons

Fans may submit monetary tips and purchase tokens through the Service. All payments are processed by Stripe, our third-party payment processor. By submitting a payment, you agree to Stripe's terms and conditions in addition to these Terms.

Tips and token purchases are final and non-refundable. Tips are made in support of the artist and are not contingent upon the performance of any specific song or request.

In some cases, where a song request associated with a tip is not performed, the Service may convert an equivalent value of that tip into non-monetary digital credits ("Tokens"). This conversion does not constitute a monetary refund and does not reverse the original transaction.

4.2 Tokens

Patrons

Tokens are a non-monetary, platform-specific digital credit used within OnRequest to interact with artist sessions, including associating value with song requests.

Tokens may be obtained through direct purchase or through conversion of monetary value submissions associated with unperformed song requests. Tokens are artist-specific and may only be used with the artist for whom they were issued.

Tokens may carry over to future shows with the same artist. Tokens have no cash value, are not redeemable for cash, and cannot be transferred between artists or accounts.

We reserve the right to modify the token system, including token values, conversion rules, and permitted uses, at any time with reasonable notice.

4.3 Artist Payouts

Artists

Artists receive payouts for tips and token transactions through Stripe Connect. OnRequest charges a platform commission on applicable transactions as disclosed during account setup. Artists are responsible for their own tax obligations related to payments received through the Service.

4.4 Merch Orders

ArtistsPatrons

Artists may offer merchandise for sale through the Service in connection with live performance sessions. Merchandise offerings may include physical items or links to external platforms for digital or remote purchases.

All merchandise transactions are the sole responsibility of the artist offering the merchandise. Artists are responsible for inventory management, fulfillment, and delivery of all merchandise, whether completed in person or through external services.

OnRequest may provide tools to facilitate merchandise display and purchase during a live session but does not guarantee availability, fulfillment, or delivery of any items.

OnRequest may charge a platform fee on applicable merchandise transactions as disclosed.

5. Content and Conduct

5.1 Your Content

All Users

You retain ownership of content you submit to the Service, including song requests, dedications, chord charts, and other materials ("Your Content"). By submitting content, you grant OnRequest a worldwide, non-exclusive, royalty-free license to use, display, and transmit Your Content in connection with operating the Service.

5.2 Prohibited Conduct

All Users

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Abuse, harass, or threaten other users
  • Attempt to gain unauthorized access to accounts or systems
  • Submit spam, malware, or harmful code
  • Circumvent payment systems or engage in fraudulent transactions
  • Violate any applicable laws or regulations

5.3 Chord Charts and Music Content

Artists

Artists are solely responsible for ensuring that any chord charts, lyrics, or musical content uploaded to OnRequest does not infringe on third-party copyrights. OnRequest is not responsible for copyright compliance of user-submitted content. We will respond to valid copyright infringement notices in accordance with applicable law.

6. Privacy

All Users

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our collection and use of information as described in the Privacy Policy.

10. Indemnification

All Users

You agree to indemnify and hold harmless OnRequest and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Termination

All Users

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions that by their nature should survive termination — including ownership provisions, warranty disclaimers, and limitations of liability — shall survive.

12. Governing Law

All Users

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved in the courts located in British Columbia, Canada.

13. Changes to These Terms

All Users

We may update these Terms from time to time. When we make material changes, we will notify you by updating the date at the top of this page and, where appropriate, providing additional notice (such as an in-app notification). Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

14. Intellectual Property — Patent Pending

All Users

The technology underlying the OnRequest platform, including its methods for real-time audience engagement, song request management, and live performance interaction, is patent pending. All rights reserved pending the outcome of such patent applications.

Nothing in these Terms grants you any right, title, or interest in OnRequest's patents, patent applications, trademarks, trade secrets, copyrights, or other intellectual property rights.
